Purchase of Products

This website is owned and operated by Advertime Ltd, trading as Verko – design for easier living ("Verko", “the seller”, “DFEL", "we", "us"). Trading address – 752c Finchley Road London NW11 7TH, United Kingdom. Registered as a Limited Company in England and Wales, Registered Company Number 1326272, VAT No. 231 7219 87.

These Terms and Conditions apply to all purchases from our website. Please read them carefully before placing an order.

1. Acceptance of your order

Your order is acknowledged on our receiving pre-approval through our credit card authorisation service. Funds are only taken from your credit card as your order is dispatched. We reserve the right to restrict the number of products you may order and to refuse any order. If you have provided us with your email address you will receive an email from us confirming that we have received your order.

This initial email is sent automatically. We will notify you again by email on dispatch of your order confirming its acceptance and dispatch. Otherwise, our acceptance of your order takes place upon delivery of the products. Only when we have accepted your order is a binding contract created between us.

2. Prices

Our prices are set out on our website in Pounds Sterling and are inclusive of United Kingdom VAT at the current rate where applicable.

Prices remain in force until we publish new prices on our website.

Delivery charges may apply and are displayed during the ordering process.

Whilst we try to ensure that all prices on our website are accurate, mistakes can sometimes occur. If we discover an error in the price of products you have ordered we will contact you as soon as possible and give you the option of either reconfirming your order at the correct price or cancel it. If we are unable to contact you we will treat the order as being cancelled. If the order is cancelled, we will refund any money that we have taken from you.

3. VAT Exemption

Qualifying Individuals purchasing products for their own personal use, may be exempt from paying VAT for certain Products. We will require you to submit a simple declaration form that confirms you are eligible to receive goods at a VAT exempt price as required by HM Customs & Excise. If you are eligible for relief, and complete the declaration form, VAT will be excluded for the relevant product price. VAT will still be charged on delivery charges. It will be the Buyers responsibility to ensure that they are exempt from VAT for the Products ordered. Click to view the HM Customs and Excise website VAT pages for advice. Buyers may be liable to prosecution if they wrongly declare themselves as VAT exempt for relevant products.

4. Availability

All orders are subject to the availability of products. If the products you order are not available we will notify you (where possible). No money will be taken against any stock order until the goods are dispatched.

5. Content

We have taken reasonable care to ensure the accuracy of the content on our website, however, in accordance with the applicable laws, we disclaim all warranties (express or implied) as to the accuracy of the information contained in any of the material on our site.

6. Delivery

Our aim is to get your order delivered within 7 working days of receipt of order to addresses within the United Kingdom.

We will attempt to deliver products ordered by you to the delivery address stated on your order form. If products are returned to us as undeliverable we shall refund the price of the products and our delivery charges less £5 or the price of the products (whichever is less) in respect of our postal and administrative costs. If not returned to us, you are responsible for providing a correct delivery address and post code, any loss of revenue, product and delivery costs incurred by us due to an incorrect or incompelete delivery address provided to us will be incurred by you.

You will not become the owner of the products until they have been delivered and full and final settlement is paid by you, at which time they will also become your risk and we will not be liable for any subsequent damage, loss or destruction to them.

You may not use false e-mail addresses, impersonate any person or entity, or otherwise mislead as to the buyer of a product. You will be liable for any costs incurred by Verko Ltd.

7. Right to cancellation before despatch

You may cancel your order at no cost to you before the despatch of products, we will send you an e-mail to confirm despatch of your order.

8. Right to Returns and Refunds

8.1 Returns because they are damaged, defective or incorrect

If you are returning an item because of an error on our part or because it is damaged or defective, we will refund the delivery charges incurred in sending the item to you and we will reimburse your reasonable costs in returning it to us.

8.2 Other returns within 14 days of delivery

We will refund the cost of goods returned in their original packaging and in perfect condition within 14 days of delivery. We will not refund delivery charges and there is a £5.00 stocking in charge for trolleys and other large items returned..

Until you have returned the products to us, you must keep them in your possession and take reasonable care of them.

For reasons of hygiene you may not cancel your order for certain products if we have already dispatched those products to you. These include but are not limited to mattresses, pillows and personal grooming products.

The product you wish to return must be in a saleable condition in its original, undamaged packaging, and we will consider the overall condition of the product being returned when making a refund.

You must provide us with the original invoice, despatch note or other proof of purchase.

Nothing in this Returns Policy affects any statutory rights you may have as a consumer.

9. Alteration of Service or Amendments to the Conditions

We reserve the right to make changes to our website, policies, and these Conditions of Sale at any time. You will be subject to the policies and Conditions of Conditions of Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you).

10. Validity

If any of these Terms and Conditions are unenforceable it shall not affect the enforceability of the rest of these Terms and Conditions.

11. Complaints

All complaints should be addressed to Customer Services, Verko-Advertime, 752c Finchley Road London, NW11 7TH, United Kingdom. If products we deliver to you are not as ordered or are damaged, defective or of incorrect quantity you should contact us within 14 days of delivery. We will replace the incorrect, damaged or defective products or make good the shortfall in quantity or, at our option, credit the price and delivery charges of those products to you.

If you do not receive products ordered you should notify us within 28 days of the date of your order. We will deliver the products ordered or, at our option, credit the price and delivery charges of the non-delivered products to you, or if we have not accepted your order and have been unable to contact you, we will notify you of the reason for non-acceptance.

Nothing in these Terms and Conditions shall be construed to exclude or limit any rights you may have as a consumer to the extent that such liability and rights may not be excluded or limited under applicable statute or law.

12. Jurisdiction

Your order and the formation of the contract shall be governed by and interpreted in accordance with English law. The English Courts shall have jurisdiction to hear disputes between us.
